- The media owner/publisher reserves the right to refuse orders without giving reasons. The client is solely responsible for the content of the advertisements.
- No guarantee is given for the accuracy of the reproduction of advertisements submitted by telephone or changes made by telephone, as well as for unclearly written text templates or inadequate documents.
- The media owner/publisher disclaims all liability for damages resulting from printing errors. Replacement advertisements can only be requested if the meaning of the advertisement has been altered due to an error by the media owner/publisher, or if the advertisement’s chances of success are clearly and unequivocally jeopardized. It is agreed that any claim for damages will always be limited to a free replacement advertisement.
- In the event of force majeure, strikes, data loss, power outages, distribution delays, etc., all obligations to fulfill orders and provide compensation for damages are void. In particular, no compensation will be provided for unpublished advertisements. If the media owner/publisher is prevented from delivering the full calculated print run due to force majeure (postal delays, strikes, etc.), data loss, or machine breakdown, etc., they are entitled to the agreed fee (for the insertion or insert fee) if at least 75% of the calculated print run has been delivered; otherwise, they are entitled only to the corresponding share.
- Proofs for approval of the layouts will only be produced upon request. If approval requests are not answered within the specified timeframe, approval for printing (release) is considered granted. The client is responsible for the correct receipt of the print materials for the specified layout and confirms upon submission that they possess the image and data rights.
- Complaints will only be accepted up to 8 days after receipt.
- For format ads, supporting documents are provided with the invoice; for word ads, they are only provided upon request and against reimbursement of costs.
- Invoices are payable within 14 days of receipt. In case of late payment, 10% interest plus 5% collection costs and processing fees will be charged. Any discounts not agreed upon will be retroactively charged.
- The media owner/publisher reserves the right to withdraw from orders at any time without giving reasons, even if an agreement for repeated publication exists.
- Placement requests are only binding for the media owner if a placement surcharge is paid. Otherwise, the publisher will endeavor to fulfill requests, as is also the case with requests for exclusivity on the same or following page.
- The media owner/publisher accepts no liability whatsoever for the loss of submissions.
- Costs for graphic design and changes to agreed-upon specifications, existing advertisements, and the delivery of photos or final artwork are borne by the client.
Graphic design costs: €87 net per hour. Time spent on press or advertising photos: €87 net per hour. Costs for consulting services, etc., provided by one of the managing directors: €160 net per hour.
- For annual statements, the customer discount achieved according to the tariff is granted. If the number/scope agreed upon in writing or verbally is not reached, any excess customer discount claimed or granted will be charged back.
- In the event of a change in advertising rates, this will take effect immediately for existing contracts, in particular inflation adjustments at the turn of the year.
- The transmission of photos or graphics to customers/readers does not constitute a transfer of rights or consent to any use, e.g., on the internet or in other media! All rights remain exclusively with MP-MEDIA & POWER GmbH, even in the case of data transmission. Designed advertisements or photos constitute the intellectual property of MP-MEDIA & POWER GmbH.
- By submitting photos for articles, e.g., for participation in the „15 Years of ROFAN-KURIER“ photo competition or other photo competitions organized by MP MEDIA & POWER GmbH, the submitter declares that they possess the rights to use the submitted images and that no third-party rights are infringed. The submitter and any third parties depicted in the images consent to publication and agree to indemnify and hold MP MEDIA & POWER GmbH harmless from any claims made by third parties in this regard. Furthermore, the submitter grants MP MEDIA & POWER GmbH the unrestricted, royalty-free right (right of use) to use the submitted images for all its purposes, such as publication in the monthly newspaper ROFAN-KURIER, publication on the website www.rofankurier.at, publication on social networks, or for any other form of company advertising.
- Data processing: Personal data is processed within the framework of a business relationship with customers and suppliers, including automatically generated and archived text documents (such as correspondence) in these matters, as well as for initiating business regarding our own supply or service offerings, including automatically generated and archived text documents (such as correspondence) in this matter, based on applicable regulations and express or implied consent, unless such use has been objected to.

Reproduction, duplication, distribution, and the use of contributions within the meaning of Section 44, paragraphs 1 and 2 of the German Copyright Act (UrhG) are expressly prohibited in accordance with Section 44, paragraph 1, second sentence of the German Copyright Act (UrhG).
